PROBLEMATIC ASPECTS OF THE PROSECUTOR'S INVOLVEMENT IN THE JUDICIAL STAGES OF CRIMINAL PROCEEDINGS

Abstract

The article is devoted to certain problems of the prosecutor's participation in the judicial stages of the criminal process. After analyzing the positions of legal scholars, the authors draw attention to the competition of the prosecutor's functions in the form of supervision and maintenance of public prosecution. Attention is also paid to the duty of the prosecutor to waive charges in court if there are appropriate grounds, and a conclusion is drawn about the imperfection of legislative norms in this matter. In addition, the authors touched upon some problematic aspects of the judicial investigation and the most typical problems related to the quality of the work of prosecutors in the framework of the consideration of a criminal case in court.
